Samsung responds to Apple’s appeal against the Galaxy Tab

Samsung has responded to Apple’s latest appeal against its Galaxy Tab 10.1, claiming that 4G capability of Samsung Tab means it is not any in competition with Apple’s 3G iPad 2.

Two weeks back, Apple made a successful appeal regarding the US federal decision which prevented Apple’s attempt to seize the Galaxy Tab’s markets, concluding Samsung violated three design patents and a software patent.

Foss Patents’ Florian Mueller thinks that Apple is starting from a remarkable position but it’s important for them to win to rule over all the four factors of the injunctions:

  • Equity Balance
  • Public interest.
  • Likelihood of success on the merits;
  • likelihood of irreparable harm

A circuit judge, Judge O’Malley, went much beyond majority opinion and debated that one could infer into the district court’s original decision, denied the preliminary injunction by Apple. Disputes among the two companies, Samsung and Apple, could not be negotiated even in a court in San Francisco last week.
